Mobility is a cornerstone of life. Guaranteeing the basic conditions that enable mobility is a matter for the State. Mobility requires an effective transport infrastructure, which also includes railways. The need for the expansion of such an infrastructure conflicts with the need to protect the environment and health, in particular with regard to those affected by traffic noise. A balance must be obtained between these conflicting interests; it is primarily the task of the State to bring about this balance, notably by introducing legislation for noise protection in the context of railway infrastructure planning. This legislation is the subject of this work.
