»The Incidental Consequence in the German System of Penal Sanctions«The German penal code does not only include custodial or pecuniary penalties. In line with § 45 StGB and supplementary penal provisions certain convictions may also entail specific legal consequences like the loss of the right to hold public office. These effects are classified as incidental consequences of the penalty, but may strike the convict even harder than the main sentence itself. Despite their frequent application the legal nature of these so called »side effects« remains widely ambiguous.
