Nevertheless under the code of criminal procedure a judge frequently makes decisions to the disadvantage of the accused before he delivers a judgement in the main proceedings. The examination of the requirements of the code of criminal procedure concerning the impartiality of judges by those of Art. 6 § 1 ECHR points out: The course of criminal proceedings is not compatible with the right to an impartial judge.
