»The Double-Sided Restructuring Trust within the Corporate Crisis«Since a few years, the so called »double-sided restructuring trust« (doppelseitige Sanierungstreuhand) is regularly being implemented in Germany as a legal instrument for credit security as well as for restructuring in the corporate crisis, in large and public constellations (Opel / General Motors) as well as in mid-size companies. The book analyzes the backgrounds, the individual interest constellations, the legal structures as well as the potential risks of such double-sided restructuring trust. The focus lays on content and drafting of the underlying trust agreement, risk avoidance strategies as well as the effect of a potential insolvency of one of the involved parties.
