The 2017 amendment of the German Agency Work Act (Arbeitnehmerüberlassungsgesetz) imposes new restrictions on agency work insofar as the duration of an assignment may not exceed 18 months and as even collective agreements cannot usually waive equal pay after 9 months. The author assesses whether these rules are compatible with the German Constitution and EU Law and whether, separately or jointly, they are proportionate. To this end, agency work laws of other EU States are also taken account of.
