»Cross-border use of Freedom in the Federal State of Germany. Fundamental Rights Protection against Discriminations and Restrictions by the German Federal States«The study addresses the question of whether the fundamental rights under the German Basic Law offer protection against discriminations and restrictions in the cross-border area between the German federal states imposed by state laws, as conveyed by the fundamental freedoms of European Union law for the use of freedom across the borders of a Member State. The author comes to the conclusion that although the fundamental rights under the German Basic Law allow such protection within Germany, the effectiveness of this protection falls short of the level of protection under European Union law.
