The question of the criminal liability of transnational companies for international crimes is increasingly important. This study is grounded in the current state of the art at the international level and across multiple jurisdictions. It explains corporate liability using an attribution model: the conduct of the company's employees and its lack of adequate supervision and organisation are attributed to the company. The study also shows that complicity is the most relevant mode of participation. The overall conclusion is that the preventive effect of criminal law in this area is limited and needs to be complemented by a series of other measures as part of a holistic approach to corporate criminality.
