»Cash Pooling under the Aspects of Capital Preservation and Capital Raising in German and Turkish Group Law«The thesis analyses the compatibility of the cash pooling practice with capital maintenance rules as well as capital raising rules in de facto GmbH and AG groups under German and Turkish law. In this context, the conditions for admissibility of the cash pool loans and the liability risks of the participants are discussed in detail from the point of view of both legal systems. Further it is analysed, according to which law system cash pooling is simpler and legally more secure in regard to the above-mentioned aspects.
