The latter's intention was to damper rising health costs in the German statutory health insurance. However, manufacturers of pharmaceuticals already face a lot of justified encroachments upon their fundamental rights. That is why the claim is often made that these aggregated liabilities lead to an unconstitutional state. The thesis describes the existing solutions and develops a new approach to deal with these aggregated liabilities.
