»The Business Judgment Rule as General Legal Figure«The study considers the question if the business judgment rule pursuant to Section 93 (1) Sentence 2 Stock Corporation Act (AktG) applies to other legal forms of German civil law. The author concludes that the business judgment rule is not specific to stock corporation law. In fact, the business judgment rule is a general legal figure which also applies to other legal forms under the condition of certain modifications.
