Preliminary Discussion on the Necessary Conditions of Juristic Act - Take the Change of Property Right as an Example Stored in the Academic Library of Laws, Tianjin University of Finance & Economics

Bok av Chen Guanghua
The book regards juristic act as a tool of realizing the autonomy of private law, but its function is limited to the value range defined in the statutes. Therefore, juristic act is not and unnecessary to be provided with corresponding intentions. Intention expression is indeed a core element of juristic act, but it is subject to the will of the interested parties and the establishing conditions of its main purpose, the legal effect, are unilaterally decided by the law-maker. The will of the parties interested and the will of the law-maker mutually decide the constitutive conditions of juristic act from two different aspects. Thus, juristic act inevitably and actually corresponds to the necessary conditions of legal effect. In a word, juristic act is a necessary condition of legal effect under the intention of the parties interested.
